In more than 100 judgements, the European Court of Human Rights has referred to ‘European Public Order’. In some of them, the Court has stated that the European Convention on Human Rights is a constitutional document of European public order, but the Court has never explained what it means. European public order is an abstract term – it can mean different things in different contexts. It is important to understand what it means for two main reasons. First, the Court uses it in its reasoning and one can assume that it affects the outcome of cases in which it is mentioned. Second, references to European public order can manifest the Court’s own understanding of its constitutional role and function. In this presentation I will discuss certain areas in which the Court has used European public order, and I will then try to see if there is any logic that can unite these areas.
